Limited Product Warranty

1. Scope.
This Limited Product Warranty (“Warranty”) is provided by Be Well By Kelly, Inc. (“Company,” “we,” “our,” or “us”) and applies to physical products purchased directly from www.kellyleveque.com (“Website”).
Covered Products:
- Home Products: The Masher and other kitchen tools and accessories sold under the Be Well Home brand.
- Ingestible Products: Protein powders, Creatine with Creavitalis®, Essential Amino Acids, Essential Amino Acids, and Vegan Magnesium Supplement.
2. What This Warranty Covers.
- Home Products: Company warrants that Home Products will be free from defects in materials and workmanship under normal household use for a period of one (1) year from the date of original purchase.
- Ingestible Products: Company warrants that Ingestible Products will conform to the product specifications stated on the product label at the time of delivery.
3. What This Warranty Does Not Cover.
This Warranty does not cover: (a) damage resulting from misuse, abuse, modification, alteration, or use inconsistent with product instructions; (b) normal wear and tear or cosmetic damage that does not affect product functionality; (c) damage resulting from use with non-stick, ceramic-coated, or enameled cookware; (d) products used for commercial or industrial purposes; (e) products purchased from unauthorized resellers (products purchased directly from www.kellyleveque.com or the official Be Well by Kelly LeVeque storefront on Amazon.com are authorized purchases and covered under this Warranty; products purchased from any other third-party seller are not covered); (f) products for which proof of purchase cannot be provided.
4. How to Make a Warranty Claim.
Contact us at home@kellyleveque.com with your order number, a description of the issue, and photos if applicable. We will make reasonable efforts to respond promptly.
5. Warranty Remedy.
Company will, at its sole discretion, repair, replace, or refund the original purchase price of the product. Company may require you to return the product before processing a warranty claim. Shipping costs for warranty returns will be handled as follows: for confirmed defective products, Company will cover return shipping; for all other warranty claims, you are responsible for return shipping costs.
6. Limitation of Implied Warranties.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE PERIOD OF THIS EXPRESS WARRANTY.
Some states and provinces do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
7. Limitation of Remedies.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, COMPANY SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE ANY PRODUCT. COMPANY’S TOTAL LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT.
Some states and provinces do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
8. Your Legal Rights.
This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state and province to province.
9. Governing Law.
This Warranty shall be governed by the laws of the State of California, without regard to conflict of law provisions, and is subject to the Terms of Use posted on the Website.
